§ 4722. Definitions As used in this chapter:
- (1) “Person” means any individual, corporation, association, partnership, reciprocal exchange,
interinsurer, Lloyds insurer, fraternal benefit society, and any other legal entity
engaged in the business of insurance, including agents, brokers, appraisers, and adjusters.
Person also means medical, dental, optometric, and hospital service plans as defined
in this title. For the purposes of this title, medical, dental, optometric, and hospital
service plans shall be deemed to be engaged in the business of insurance. (2) “Commissioner” means the Commissioner of Financial Regulation. (3) “Insurance policy” or “insurance contract” means any contract of insurance, indemnity,
medical, dental, optometric, or hospital service, suretyship, or annuity issued, proposed
for issuance, or intended for issuance by any person. (4)(A) “Abusive litigation” means litigation or other legal action to deter, prevent, sanction,
or punish any person engaging in legally protected health care activity by:
