§ 2139. Tender of confession of judgment

  • When a debtor, before or after an action is commenced, tenders to the creditor or
    to his or her agent or attorney holding the obligation or account against such debtor,
    a confession of judgment before a district judge for the amount of the debt and costs
    then accrued, and such tender is refused, the creditor shall not recover the costs
