§ WA.7.058. HEARING
HEARING. If the person charged requests or the commission orders a hearing, the commission shall order and shall give notice of the hearing. The commission by order may find that a violation has occurred and may assess a penalty, may find that a violation has occurred but that a penalty should not be assessed, or may find that a violation has not occurred. In making a penalty decision, the commission shall analyze each factor prescribed by Section 7.053 . All proceedings under this section are subject to Chapter 2001 , Government Code. Added by Acts 1997, 75th Leg., ch. 1072, Sec. 2, eff. Sept.1, 1997.
