§ SD.8834.113. CONSIDERATIONS FOR RULES AND ORDERS
CONSIDERATIONS FOR RULES AND ORDERS. When adopting a rule or issuing an order, the board shall consider: (1) the availability of surface water or alternative water supplies; (2) the economic effects on persons and the community; (3) the degree and effect of subsidence on the surface of the land; and (4) the differing topographical and geophysical characteristics of the land.
