§ SD.8508.0152. CIVIL PENALTY
CIVIL PENALTY; INJUNCTIVE RELIEF. (a) A person who violates a rule or order of the authority is subject to a civil penalty of not less than $50 or more than $1,000 for each day of violation. (b) The authority may sue to recover the penalty in a district court in the county in which the violation occurred. A penalty shall be paid to the authority. (c) The authority may sue for injunctive relief in a district court in the county in which the violation of a rule or order occurred or is threatened. (d) The authority may sue for injunctive relief and a penalty in the same proceeding. Added by Acts 2019, 86th Leg., R.S., Ch. 468 (H.B. 4172 ), Sec. 1.03, eff. April 1, 2021.
