§ OC.2051.404. INTERROGATORIES

INTERROGATORIES. (a) Except as provided by Subsection (b), the secretary of state may serve interrogatories on an athlete, compliance coordinator, or any person subject to this chapter, or an officer, director, partner, or associate of the person, if the interrogatories are reasonable and necessary to conduct an investigation under this chapter. (b) The secretary may not serve interrogatories on an athlete who is not represented by an attorney. (c) Interrogatories served under Subsection (a) must be answered: (1) completely; (2) in writing; (3) under oath; (4) not later than the 30th day after the date the interrogatories are mailed, or within a time period determined by the secretary; and (5) by the individual to whom the interrogatories are directed or, if the interrogatories are directed to an entity, by an authorized representative of the entity. (d) If the answers to interrogatories served under Subsection (a) disclose a violation of this chapter, the secretary shall take disciplinary action as provided by Section 2051.405 . (e) The interrogatories and answers to the interrogatories are: (1) confidential and not open to public inspection, except by a court order; and (2) exempt from disclosure under Chapter 552 , Government Code. (f) The secretary may disclose confidential information to a governmental authority or a quasi-governmental authority. Acts 1999, 76th Leg., ch. 388, Sec. 1, eff. Sept. 1, 1999.
