§ IN.1702.153. PROHIBITED DISCRIMINATION AND DISTINCTIONS

PROHIBITED DISCRIMINATION AND DISTINCTIONS. Except as provided by Section 1702.154 and other applicable provisions in this code specific to particular types of accident and health coverage or health care plan coverage, an insurer or health maintenance organization may not, with respect to an accident and health insurance policy or health care plan contract, make or permit a distinction or an unfair discrimination between individuals of the same class and equal life expectancy regarding: (1) the rate charged; (2) the dividend or other payable benefit; or (3) any of the other terms of the policy or contract. Added by Acts 2025, 89th Leg., R.S., Ch. 581 (H.B. 2221 ), Sec. 2, eff. September 1, 2025.
