§ IN.1501.103. TREATMENT OF CERTAIN CONDITIONS AS PREEXISTING PROHIBITED
TREATMENT OF CERTAIN CONDITIONS AS PREEXISTING PROHIBITED. (a) A small or large employer health benefit plan issuer may not treat genetic information as a preexisting condition described by Section 1501.102 (b) in the absence of a diagnosis of the condition related to the information. (b) A small or large employer health benefit plan issuer may not treat pregnancy as a preexisting condition described by Section 1501.102 (b). Added by Acts 2003, 78th Leg., ch. 1274, Sec. 3, eff. April 1, 2005.
