§ OC.2051.403. ENFORCEMENT OF SUBPOENA AND SUMMONS

ENFORCEMENT OF SUBPOENA AND SUMMONS. (a) The secretary of state shall refer a person who fails or refuses to comply with a subpoena or summons issued by the secretary under Section 2051.401 to the attorney general for enforcement. (b) On receipt of a referral under Subsection (a), the attorney general may apply to a district court of Travis County for an order requiring compliance. (c) On receipt of an application for an order under Subsection (b), a district court: (1) shall order compliance if the court determines that good cause exists for the issuance of the subpoena or summons; and (2) may modify those requirements of the subpoena or summons that the court determines are unreasonable.
