§ 9-4-5116. Abortion funding.
No state funds shall be expended to perform abortions. The limitations established in this section shall not apply to an abortion if: The pregnancy is the result of an act of rape or incest; or In the case where a woman suffers from a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the woman in danger of death unless the abortion is performed. Acts 2003, ch. 355, § 67. Compiler's Notes. Acts 2003, ch. 355, § 66 provided that no expenditure of public funds pursuant to the act shall be made in violation of the provisions of Title VI of the Civil Rights Act of 1964, as codified in 42 U.S.C. § 2000 d.
