§ 68-12-104. Expenses of care and treatment — Payment.

The necessary expenses of such care and treatment, including maintenance, personal necessities, artificial limbs, appliances and accessories and their upkeep, and of conveyance to and from the places designated for such services, shall be borne in whole or in part by the parent or guardian if financially able, or as funds are available by the department of health; provided, that the department may charge to the county in which such children with a physical disability reside a portion of the cost, the portion to be determined by the formula as authorized in § 68-12-107(4) . Acts 2011, ch. 47, § 107 provided that nothing in the legislation shall be construed to alter or otherwise affect the eligibility for services or the rights or responsibilities of individuals covered by the provision on the day before the date of enactment of this legislation, which was July 1, 2011. Acts 2011, ch. 47, § 108 provided that the provisions of the act are declared to be remedial in nature and all provisions of the act shall be liberally construed to effectuate its purposes.
