§ 56-7-3405. Failure to comply with part may constitute unfair claims settlement practice — No private cause of action created.

A pattern of failures to meet the requirements of this part may constitute an unfair claims settlement practice under the Tennessee Unfair Trade Practices and Unfair Claims Settlement Act of 2009, compiled in chapter 8 of this title. Nothing in this part shall be construed to create or imply a private cause of action for a violation of this part. Acts 2014, ch. 974, § 1. Compiler's Notes. Acts 2014, ch. 974, § 2 provided that the commissioner of commerce and insurance is authorized to promulgate rules to implement the act, which enacted this part, provided such rules shall not impose any duty or requirements not stated in the act. All such rules shall be promulgated in accordance with the Uniform Administrative Procedures Act, compiled in title 4, chapter 5.
