§ 56-54-104. Applicability of chapter.
This chapter shall apply to all health care liability claims in this state, regardless of whether or how they are covered by medical professional liability insurance. This chapter shall not apply to the state or those employed by the state to the extent that their health care liability is not covered by an insurance entity. Acts 2008, ch. 1009, § 5; 2012, ch. 798, § 30. Compiler's Notes. Former chapter 54, §§ 56-54-101 , 56-54-102 (Acts 2004, ch. 902, §§ 1, 2; 2006, ch. 744, §§ 1-7), concerning reports on medical or professional malpractice claims, was repealed by Acts 2008, ch. 1009, § 1, effective January 1, 2009.
