§ 50-3-602. Temporary variances — Notice — Duration — Renewals.
The temporary variance provided for in § 50-3-601 may be granted only after notice to employees and interested parties and opportunity for hearing. The variance may be for a period of no longer than required to achieve compliance or one (1) year, whichever is shorter. The variance may be renewed only once; provided, that longer variances may be granted in the case of employers who undertake experimental programs in safety and health that are either in cooperation with state or federal agencies or approved by the commissioner. Application for renewal of a variance must be filed in accordance with provisions in the initial grant of the variance.
