§ 47-18-2106. Violation of Tennessee Consumer Protection Act.

A violation of this part constitutes a violation of the Tennessee Consumer Protection Act. For the purpose of application of the Tennessee Consumer Protection Act, any violation of this part shall be construed to constitute an unfair or deceptive act or practice affecting trade or commerce and subject to the penalties and remedies as provided in that act, in addition to the penalties and remedies set forth in this part. If the attorney general has reason to believe that a person has violated this part, then the attorney general may institute a proceeding under this chapter. Acts 1999, ch. 201, § 7; 2019, ch. 459, § 42. Compiler's Notes. Acts 2019, ch. 459, § 55 provided that the division of consumer affairs in the department of commerce and insurance shall coordinate with the attorney general and reporter to transfer all documents, information, systems, and other material deemed relevant to the operation of the division of consumer affairs of the office of the attorney general and reporter. Amendments. The 2019 amendment rewrote (c) which read: “If the division has reason to believe that any person has violated any provision of this part, the attorney general and reporter, at the request of the division, may institute a proceeding under this chapter.” Effective Dates. Acts 2019, ch. 459, § 56. September 30, 2019.
