§ 39-17-414. Controlled substances in Schedule V.

Schedule V consists of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section. Narcotic drugs containing non-narcotic active medicinal ingredients. Any compound, mixture, or preparation containing any of the following narcotic drugs, or their salts calculated as the free anhydrous base or alkaloid, in limited quantities as set forth below, which shall include one (1) or more non-narcotic active medicinal ingredients in sufficient proportion to confer upon the compound, mixture, or preparation valuable medicinal qualities other than those possessed by narcotic drugs alone: Not more than 200 milligrams of codeine per 100 milliliters or per 100 grams; Not more than 100 milligrams of dihydrocodeine per 100 milliliters or per 100 grams; Not more than 100 milligrams of ethylmorphine per 100 milliliters or per 100 grams; Not more than 2.5 milligrams of diphenoxylate and not less than 25 micrograms of atropine sulfate per dosage unit; Not more than 100 milligrams of opium per 100 milliliters or per 100 grams; or Not more than 0.5 milligrams of difenoxin and not less than 25 micrograms of atropine sulfate per dosage unit. Stimulants, unless specifically exempted or excluded, or unless listed in another schedule, means any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers: Pyrovalerone. Depressants, unless specifically exempted or excluded or unless listed in another schedule, means any material, compound, mixture, or preparation that contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts: Brivaracetam ((2S)-2-[(4R)-2-oxo-4-propylpyrrolidin-1-yl] butanamide); Ezogabine [N-[2-amino-4-(4-fluorobenzylamino)-phenyl]-carbamic acid ethyl ester]; Gabapentin [1-(aminomethyl)cyclohexaneacetic acid]; Lacosamide [(R)-2-acetoamido-N-benzyl-3-methoxy-propionamide]; or Pregabalin [(S)-3-(aminomethyl)-5-methylhexonoic acid]. No changes were made in the substantive language in this section; however, the chemical names for the drugs were updated to conform to the most recent list used by the department of mental health and mental retardation [mental health and developmental disabilities]. Compiler's Notes. The sentencing commission terminated June 30, 1995. Sentencing Commission Comments have been retained, but do not reflect 1995 or subsequent legislation. Amendments. The 2018 amendment added present (d)(1) and redesignated former (d)(1) as present (d)(2); added present (d)(3) and redesignated former (d)(2) and (d)(3) as present (d)(4) and (d)(5), respectively. Effective Dates. Acts 2018, ch. 1040, § 13. July 1, 2018.
