§ 39-17-412. Controlled substances in Schedule IV.

Schedule IV consists of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section. Narcotic drugs, unless specifically excepted or unless listed in another schedule, means any material, compound, mixture, or preparation containing any of the following narcotic drugs, or their salts calculated as the free anhydrous base or alkaloid, in limited quantities as set forth below: Not more than 1 milligram of difenoxin and not less than 25 micrograms of atropine sulfate per dosage unit; or Dextropropoxyphene (alpha-(+)-4-dimethylamino-1,2-diphenyl-3-methyl-2-propionoxybutane). Depressants, unless specifically excepted or unless listed in another schedule, means any material, compound, mixture, or preparation that contains any quantity of the following substances, including its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation: Alfaxalone; Alprazolam; Barbital; Bromazepam; Camazepam; Carisoprodol Other name: Soma(R); Chloral betaine; Chloral hydrate; Chlordiazepoxide; Clobazam; Clonazepam; Clorazepate; Clotiazepam; Cloxazolam; Delorazepam; Diazepam; Dichloralphenazone; Estazolam; Eszopiclone; Ethchlorvynol; Ethinamate; Ethyl loflazepate; Fludiazepam; Flunitrazepam; Flurazepam; Fospropofol; Halazepam; Haloxazolam; Ketazolam; Loprazolam; Lorazepam; Lormetazepam; Mebutamate; Medazepam; Meprobamate; Methohexital; Methylphenobarbital (mephobarbital); Midazolam; Nimetazepam; Nitrazepam; Nordiazepam; Oxazepam; Oxazolam; Paraldehyde; Petrichloral; Phenobarbital; Pinazepam; Prazepam; Quazepam; Suvorexant; Temazepam; Tetrazepam; Tramadol Other names: Ultram(R) and Ultracet(R); Triazolam; Zaleplon; Zolpidem; or Zopiclone. Fenfluramine means any material, compound, mixture, or preparation that contains any quantity of the following substances, including its salts, isomers (whether optical, positional, or geometric), and salts of isomers, whenever the existence of such salts, isomers, and salts of isomers is possible: Fenfluramine; or Dexfenfluramine. Lorcaserin means any material, compound, mixture, or preparation that contains any quantity of the following substances, including its salts, isomers, and salts of such isomers, whenever the existence of such salts, isomers, and salts of isomers is possible: Lorcaserin. Stimulants, unless specifically excepted or unless listed in another schedule, means any material, compound, mixture, or preparation that contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers, and salts of isomers: Cathine ((+)-norpseudoephedrine); Diethylpropion; Fencamfamin; Fenproporex; Mazindol; Mefenorex; Modafinil; Pemoline (including organometallic complexes and chelates thereof); Phentermine; Pipradol; Sibutramine; or SPA ((-)-1-dimethylamino-1,2-diphenylethane). Other substances. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation that contains any quantity of the following substances, including its salts: Pentazocine; Butorphanol (including its optical isomers); or Eluxadoline (5-[[[(2S)-2-amino-3-[4-aminocarbonyl)-2,6-dimethylphenyl]-1-oxopropyl][(1S)-1-(4-phenyl-1H-imidazol-2-yl)ethyl]amino]methyl]-2-methoxybenzoic acid) (including its optical isomers) and its salts, isomers, and salts of isomers. Sentencing Commission Comments. No changes were made in the substantive language in this section; however, the chemical names for the drugs were updated to conform to the most recent list used by the department of mental health and mental retardation. Compiler's Notes. The sentencing commission terminated June 30, 1995. Sentencing Commission Comments have been retained, but do not reflect 1995 or subsequent legislation. Amendments. The 2018 amendment added “or” at the end of (g)(2); and added (g)(3). Effective Dates. Acts 2018, ch. 1040, § 13. July 1, 2018.
