§ 27-8-103. Levy not required.
It is not necessary that a levy shall be made on the defendant's property in order to entitle the defendant to the writ of certiorari and supersedeas. Acts 1877, ch. 132, § 1; Shan., § 4855; Code 1932, § 8990a; T.C.A. (orig. ed.), § 27-803.
