§ 53-13-101. Chapter definitions.

As used in this chapter, unless the context otherwise requires: “Apparently wholesome deer meat” means deer meat that complies with applicable standards, requirements, and procedures established by the department of agriculture; “Apparently wholesome food” means food that meets all standards of quality established by local, county, state and federal agricultural and health laws and regulations, even though the food is not readily marketable due to appearance; age; freshness, including bearing a past-due expiration date, sell-by date, use-by date, or other date; grade; size; surplus; or other condition. “Apparently wholesome food” does not include canned goods that are leaking, swollen, dented on a seam, or no longer airtight; and “Gleaner” means a person who harvests for free distribution an agricultural crop that has been donated by the owner. Section 53-7-213(e) referred to in this section, concerning the promulgation of rules to establish and enforce standards and procedures to reasonably ensure the safe and sanitary handling, inspection, processing, labeling, storage, distribution, and consumption of deer meat lawfully harvested by licensed hunters and donated to bona fide charitable or nonprofit organizations that operate food banks or on-site feeding programs to combat poverty and hunger, was deleted by Acts 2007, ch. 421, § 16. Amendments. The 2020 amendment substituted “applicable standards, requirements, and procedures established by the department of agriculture” for “the standards and procedures promulgated and enforced pursuant to § 53-7-213(e) ” in the definition of “apparently wholesome deer meat”; and substituted “appearance; age; freshness, including bearing a past-due expiration date, sell-by date, use-by date, or other date; grade; size; surplus; or other condition. ‘Apparently wholesome food’” for “appearance, age, freshness, grade, size, surplus or other condition, but” in the definition of “apparently wholesome food”.
