§ 39-14-404. Especially aggravated burglary.
Especially aggravated burglary is: Burglary of a habitation or building other than a habitation; and Where the victim suffers serious bodily injury. For the purposes of this section, “victim” means any person lawfully on the premises. Especially aggravated burglary is a Class B felony. Acts which constitute an offense under this section may be prosecuted under this section or any other applicable section, but not both. Acts 1989, ch. 591, § 1; 1990, ch. 1030, § 24. Sentencing Commission Comments. This section defines the offense of especially aggravated burglary as a burglary where the victim suffers serious bodily injury. “Victim” means any person lawfully on the premises, including guests or employees. Under this section, it makes no difference whether the burglary was committed in a habitation or any other building, since the aggravating factor is the injury to the victim. However, this section does not apply to burglaries of motor vehicles under § 39-14-402(a)(4) . Compiler's Notes. The sentencing commission terminated June 30, 1995.
