§ 82-896.13. Powers of cities, incorporated towns and counties

A. All cities and incorporated towns and counties that contain

all or part of a scenic river within the jurisdictional boundaries

of the city, town or county are hereby invested with full power to

plan, zone and enact all ordinances and regulations that are

necessary and proper to carry out the purposes of the Scenic Rivers

Act.

B. The cities, incorporated towns and counties shall follow

their respective general procedures in the conduct of legislative

functions.

C. In exercising planning and zoning functions, said cities,

incorporated towns and counties shall utilize the organization and

procedures available to cities and incorporated towns under the

general planning and zoning laws of the state. Provided that, when

a county exercises the powers provided by the Scenic Rivers Act, the

board of county commissioners of that county shall perform the

obligations and exercise the powers in the same manner as a local

legislative body or mayor of a city, incorporated town or

municipality.
