§ 738.04.

In each municipal corporation maintaining a sanitary police pension fund, the legislative

authority thereof each year, in the manner provided for other municipal levies and

in addition to all other levies authorized by law, may levy a tax, not to exceed one-thirtieth

of a mill on each dollar, upon all the real and personal property listed for taxation

in such municipal corporation.  In the matter of such levy, the board of trustees of the fund shall be subject to

the law controlling the heads of departments in such municipal corporation and shall

discharge all the duties required of such heads of departments. A failure of such board to act in the manner required of the heads of departments

of such municipal corporation, in the making of such levy, shall not limit the power

of the legislative authority thereof to make such levy.
