§ 3929.03.

An employee who recovers against his employer for injuries sustained while in the

employ of his employer, and sustained because of the negligence of the employer or

negligence for which said employer is liable, is subrogated to all the rights of the

employer under any contract or policy of insurance against loss or damage resulting

to said employer from the injury or death of an employee while in the service of such

employer, whether the person, partnership, or corporation contracting with said employer

or issuing such policy of insurance has been made a party to the action for damages

sustained or not.
