§ 3923.07.
If any policy provision set forth in section 3923.04 or 3923.05 of the Revised Code is in whole or in part inapplicable or inconsistent with the coverage provided by
a policy of sickness and accident insurance, the insurer shall, with the approval
of the superintendent of insurance, omit from such policy any inapplicable provision
or part of a provision and shall, with the approval of the superintendent, modify
any inconsistent provision or part of a provision in such manner as to make the provision
as contained in the policy consistent with the coverage provided by the policy. In any such policy an insurer may at its option substitute for, or use in lieu of,
any one or more of the policy provisions set forth in sections 3923.04 and 3923.05 of the Revised Code a corresponding policy provision or corresponding policy provisions of different
wording approved by the superintendent which is not less favorable in any respect
to the insured or the beneficiary. No policy provision not subject to sections 3923.04 and 3923.05 of the Revised Code shall make any policy of sickness and accident insurance or any part of any such
policy less favorable in any respect to the insured or the beneficiary than the provisions
thereof which are subject to such sections.
