§ 3905.211.

(A) In the absence of actual malice, an insurer, the authorized representative of an

insurer, an insurance agent, the superintendent of insurance, or any organization

of which the superintendent is a member, which organization compiles the information

provided pursuant to section 3905.21 of the Revised Code and makes it available to other insurance commissioners or to regulatory or law enforcement

agencies, is immune from any civil liability that otherwise might be incurred or imposed

as a result of either of the following: (1) Any statement required by section 3905.21 of the Revised Code or any information relating to any such statement, which information may be requested

in writing by the superintendent; (2) Any statement of an insurer that has terminated an insurance agent to an insurer

or agent, or any statement of an insurance agent to an insurer or agent, which statement

is limited solely to whether a termination for any of the reasons set forth in division (B) of section 3905.14 of the Revised Code was reported to the superintendent, provided the propriety of any such termination

is certified in writing by an officer or authorized representative of the insurer

or agent terminating the relationship. (B) In any action brought against a person that may have immunity under division (A)

of this section for making any statement required by section 3905.21 of the Revised Code or providing any information relating to any such statement, which information may

have been requested in writing by the superintendent, the party bringing the action

shall plead specifically in any allegation that division (A) of this section does

not apply because the person making the statement or providing the information did

so with malice. (C) Nothing in this section shall abrogate or modify any statutory or common law privilege

or immunity that otherwise applies.
