§ 3127.23.
(A) Each party in a child custody proceeding, in the party's first pleading or in an
affidavit attached to that pleading, shall give information if reasonably ascertainable
under oath as to the child's present address or whereabouts, the places where the
child has lived within the last five years, and the name and present address of each
person with whom the child has lived during that period. In this pleading or affidavit, each party also shall include all of the following
information: (1) Whether the party has participated as a party, a witness, or in any other capacity
in any other proceeding concerning the allocation, between the parents of the same
child, of parental rights and responsibilities for the care of the child including
any designation of parenting time rights and the designation of the residential parent
and legal custodian of the child or that otherwise concerned the custody of or visitation
with the same child and, if so, the court, case number and the date of the child custody
determination, if any; (2) Whether the party knows of any proceedings that could affect the current proceeding,
including proceedings for enforcement of child custody determinations, proceedings
relating to domestic violence or protection orders, proceedings to adjudicate the
child as an abused, neglected, or dependent child, proceedings seeking termination
of parental rights, and adoptions, and, if so, the court, the case number, and the
nature of the proceeding; (3) Whether the party knows of any person who is not a party to the proceeding and has
physical custody of the child or claims to be a parent of the child who is designated
the residential parent and legal custodian of the child or to have parenting time
rights with respect to the child or to be a person other than a parent of the child
who has custody or visitation rights with respect to the child and, if so, the names
and addresses of those persons. (B) If the declaration under division (A)(1), (2), or (3) of this section is in the affirmative,
the declarant shall give additional information as required by the court. The court may examine the parties under oath as to details of the information furnished
and as to other matters pertinent to the court's jurisdiction and the disposition
of the case. (C) Each party has a continuing duty to inform the court of any child custody proceeding
concerning the child in this or any other state that could affect the current proceeding. (D) If a party alleges in an affidavit or a pleading under oath that the health, safety,
or liberty of a party or child would be jeopardized by the disclosure of identifying
information, the information shall be sealed and may not be disclosed to the other
party or the public unless the court orders the disclosure to be made after a hearing
in which the court takes into consideration the health, safety, and liberty of the
party or child and determines that the disclosure is in the interests of justice. (E) A public children services agency, acting pursuant to a complaint or an action on
a complaint filed under section 2151.27 of the Revised Code , is not subject to the requirements of this section. (F) As used in this section, “abused child” has the same meaning as in section 2151.031 of the Revised Code , “neglected child” has the same meaning as in section 2151.03 of the Revised Code , and “dependent child” has the same meaning as in section 2151.04 of the Revised Code .
