§ 1721.08.
Any cemetery association organized under the laws of this state may sell and convey
by deed in fee simple to a corporation organized not for profit under the laws of
this state for the purpose of erecting and maintaining a public monument or memorial
to any distinguished deceased person, such portion of the real estate of the association
as is selected and agreed upon between it and such corporation, which is not used
by the association, and which has not been disposed of by it for burial purposes. Such sale shall be at a price payable in a manner and on terms agreed upon between
the association and such corporation. The land sold and conveyed shall thereafter be exclusively owned, held, and controlled,
by the corporation purchasing it for the interment of such a deceased person, and
for the erection and maintenance thereon of such monument or memorial, and for no
other purpose. Lands so sold and conveyed, so long as they are held and used for the purposes designated
in this section, shall not be mortgaged, nor be subject to sale for debts.
