§ 1533.95.

(A) The department of natural resources is not liable for any death or injury to person

or property that may result from the operation of a tag fishing tournament regardless

of whether or not a permit has been issued for the operation of that tournament under section 1533.92 of the Revised Code . (B) No employee, officer, agent, or official of the department is liable for any death

or injury to person or property that may result from the operation of a tag fishing

tournament regardless of whether or not a permit has been issued for the operation

of that tournament under section 1533.92 of the Revised Code unless it is established in an action brought in the court of claims within one year

after that tournament that the acts of the employee, officer, agent, or official giving

rise to the death or injury were wanton, willful, and malicious.  Within six months of the final judgment of the court of claims that the acts of

the employee, officer, agent, or official giving rise to the death or injury were

wanton, willful, and malicious, the aggrieved party may file an action for damages

in the court of common pleas of the county of his residence or where the death or

injury occurred.
