§ 5515.10.

(A) As used in this section: (1) “Telecommunications carrier” has the same meaning as in section 4927.01 of the Revised Code . (2) “ Telecommunications or utility structure ” means any facility, line, pipe, cable, or other equipment used by a telecommunications

carrier or utility provider to provide service. (3) “ Utility provider ” means any entity described in section 4905.03 of the Revised Code , regardless of whether the entity is a public utility under section 4905.02 of the Revised Code . (4) “ Abandoned ” does not include a change in ownership of the telecommunications or utility structure. (B) The department of transportation shall make reasonable attempts to identify the owner

of an abandoned telecommunications or utility structure in, upon, under, or otherwise

occupying a road or highway of the state highway system or right-of-way. (C) If all reasonable attempts to identify the owner under division (A) of this section

have failed, the department may remove or cause the removal of the abandoned telecommunications

or utility structure.  The department may retain a third party to remove the abandoned telecommunications

or utility structure.
