§ 90-113. 38. Maximums for certain fees.
(For effective until date - see note) The fee to obtain a certificate of certification as an alcohol and drug counselor, prevention specialist, clinical supervisor, substance abuse residential facility director, or certified criminal justice addictions professional may not exceed four hundred seventy-five dollars ($475.00). The fee to renew a certificate may not exceed one hundred fifty dollars ($150.00). (For postponed effective date, see note) The fee to obtain a certificate of certification as an alcohol and drug counselor, prevention specialist, clinical supervisor, or certified criminal justice addictions professional may not exceed four hundred seventy-five dollars ($475.00). The fee to renew a certificate may not exceed one hundred fifty dollars ($150.00). The fee to obtain a certificate of licensure for a clinical addictions specialist pursuant to deemed status shall not exceed one hundred fifty dollars ($150.00). The fee to renew a license for a clinical addictions specialist pursuant to deemed status shall not exceed one hundred dollars ($100.00). The fee to obtain a license for a clinical addictions specialist pursuant to all other procedures authorized by this Article shall not exceed four hundred seventy-five dollars ($475.00). The fee to renew the license shall not exceed one hundred fifty dollars ($150.00). The fee to obtain a registration as a registrant shall not exceed one hundred fifty dollars ($150.00). The fee to renew a registration shall not exceed one hundred fifty dollars ($150.00). There shall be a reexamination fee of one hundred fifty dollars ($150.00) which shall be paid for each reexamination in addition to the fees authorized pursuant to subsection (a) of this section. There shall be a fee not to exceed twenty-five dollars ($25.00) for rescheduling any examination. There shall be a fee not to exceed twenty-five dollars ($25.00) to obtain a written verification or additional copy of a credential issued by the Board. There shall be a late renewal fee not to exceed one hundred twenty-five dollars ($125.00). In addition to any other prescribed fees, the Board shall charge a fee not to exceed one hundred fifty dollars ($150.00) for each administration of the test an applicant must pass to be credentialed as a United States Department of Transportation substance use disorder professional. Subsection (a) Set out Twice. - The first version of subsection (a) set out above is effective until the conditions described in Session Laws 2019-240, s. 9(h), have been met. The second version of subsection (a) set out above is effective after the conditions have been met. Session Laws 2019-240, s. 9(h), provides that the amendment is effective upon the expiration of the last certified substance abuse residential facility director credential issued prior to November 6, 2019 by the North Carolina Substance Abuse Professional Practice Board. The North Carolina Substance Abuse Professional Practice Board shall notify the Revisor of Statutes when the last credential issued by the Board has expired. Editor's Note. - Session Laws 2019-240, s. 8(p), made the amendment to subsections (a) and (f) of this section by Session Laws 2019-240, s. 8(h), effective January 1, 2020, and applicable to licenses granted or renewed on or after that date. Session Laws 2019-240, s. 9(a), effective November 6, 2019, provides: "The certified substance abuse residential facility director credential is discontinued. The North Carolina Substance Abuse Professional Practice Board shall no longer issue or renew a certified substance abuse residential facility director credential to any person." Session Laws 2019-240, s. 9(h), made the amendment of subdivision (26) by Session Laws 2019-240, s. 9(c), effective upon the expiration of the last certified substance abuse residential facility director credential issued prior to the effective date of this act by the North Carolina Substance Abuse Professional Practice Board. The North Carolina Substance Abuse Professional Practice Board shall notify the Revisor of Statutes when the last credential issued by the Board has expired. Effect of Amendments. - Session Laws 2005-431, s. 1, effective September 22, 2005, in subsection (a), substituted "substance abuse residential facility director" for "residential facility director" and inserted "or certified criminal justice addictions professional" in the first sentence; in subsection (b), substituted "license/licensure" for "certification" "license for a clinical addictions specialist pursuant to deemed status shall" for "certificate may" and "license shall" for "certificate may" and made minor stylistic changes; substituted "shall not exceed" for "shall be" twice in subsection (b1); in subsection (c), substituted "authorized pursuant to" for "required under" and added the last sentence; rewrote subsection (d); and added subsections (e) and (f). Session Laws 2019-240, s. 8(h), substituted "an alcohol and drug counselor, prevention specialist" for "a substance abuse counselor, substance abuse prevention consultant" in the first sentence of subsection (a); and substituted "substance use disorder" for "substance abuse" in subsection (f). For effective date and applicability, see editor's note. Session Laws 2019-240, s. 9(e), deleted "substance abuse residential facility director" following "clinical supervisor" in the first sentence of subsection (a).
