§ 90-113. 100. (Repealed effective July 1, 2021) Short title.

This act may be cited as the "North Carolina Epilepsy Alternative Treatment Act." The purpose of this act is to permit the use of hemp extract as an alternative treatment for intractable epilepsy. The General Assembly finds that there are children in this State suffering from intractable epilepsy for which currently available treatment options have been ineffective. Hemp extract shows promise in treating children with intractable epilepsy. History (2014-53, s. 2; 2015-154, s. 2.) Cross References. - As to exemption from penalties in Chapter 90 for use or possession of hemp extract for the treatment of intractable epilepsy, see G.S. 90-94.1 . Section Repealed Effective July 1, 2021. - Session Laws 2015-154, s. 8.5(a), repealed this section effective July 1, 2021. Editor's Note. - Session Laws 2014-53, s. 5, as amended by Session Laws 2015-154, s. 8, made this Article effective July 3, 2014. Session Laws 2014-53, s. 1, provides: "The University of North Carolina at Chapel Hill and East Carolina University may, and Duke University and Wake Forest University are encouraged to, conduct research on hemp extract development, production, and use for the treatment of seizure disorders and to participate in any ongoing or future clinical studies or trials." Session Laws 2014-53, s. 4, provides: "No later than October 1, 2014, the Department of Health and Human Services shall establish and adopt temporary rules to implement the provisions of this act." Effect of Amendments. - Session Laws 2015-154, s. 2, effective July 16, 2015, rewrote subsections (b) and (c).
