§ 66-411. Items not to be modified.
No item included in a dealer purchase shall be sold, traded or otherwise disposed of, melted, cut or otherwise changed in form nor shall any item be removed from the licensed premises, or other location specified on the application for a special occasion permit, for a period of seven days from the date the transaction was reported in accordance with G.S. 66-410. History (1981, c. 956, s. 1; 2009-482, s. 5; 2012-46, ss. 15, 22.) Editor's Note. - Former G.S. 66-170 was recodified as this section by Session Laws 2012-46, s. 15, effective October 1, 2012, and applicable to offenses committed on or after that date. Session Laws 2009-482, s. 6, provides in part: "No dealer who is required to be licensed under this act, but who was not required to be licensed prior to the effective date of this act, shall be guilty of engaging as a dealer in the business of purchasing precious metals without a license during the period between October 1, 2009, and January 1, 2010." This act became effective October 1, 2009. Session Laws 2012-46, s. 33, provides: "This act becomes effective October 1, 2012, and applies to offenses committed on or after that date. Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions." Effect of Amendments. - Session Laws 2009-482, s. 5, effective October 1, 2009, deleted "such" preceding "item", inserted "or other location specified on the application for a special occasion permit" in the middle, substituted "seven days" for "five days", and substituted "transaction was reported in accordance with G.S. 66-169" for "purchase was made" at the end. Session Laws 2012-46, s. 22, substituted "G.S. 66-410" for "G.S. 66-169." For effective date and applicability provision, see Editor's note. Opinions of Attorney General Editor's Note. - The opinion below was issued under former G.S. 66-170. The five-day time period during which a precious metal dealer must hold purchased items before sale is calculated under G.S. 1A-1, Rule 6(a), and the dealer may sell such items on the sixth day.
