§ 32C-4-402. Relation to Electronic Signatures in Global and National Commerce Act.
The provisions of this Chapter governing the legal effect, validity, or enforceability of electronic records or electronic signatures, and of contracts formed or performed with the use of those records or signatures, conform to the requirements of Section 102 of the Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7002) and supersede, modify, and limit the requirements of the Electronic Signatures in Global and National Commerce Act. History (2017-153, s. 1.) NORTH CAROLINA COMMENT This section modified Section 402 of the Uniform Power of Attorney Act by omitting its provisions and bringing forward in their place the provisions of G.S. 36C-11-1102 in an effort to create consistency in North Carolina law with respect to the relation to Electronic Signatures in Global and National Commerce Act. Editor's Note. - Session Laws 2017-153, s. 3, provides, in part: "The Revisor of Statutes shall cause to be printed, as annotations to the published General Statutes, all relevant portions of the Official Comments to the Uniform Power of Attorney Act (2006) and all explanatory comments of the drafters of this act as the Revisor may deem appropriate."
