§ 161-11. 5. Fees to be remitted to State Treasurer.
Six dollars and twenty cents ($6.20) of each fee collected by the register of deeds under G.S. 161-10(a)(1) and (a)(1a) shall be remitted by the register of deeds to the county finance officer, who shall remit the funds to the State Treasurer on a monthly basis to be credited as follows: Fifty-five percent (55%) to the Floodplain Mapping Fund established under G.S. 143-215.56A. Twenty percent (20%) to the General Fund as nontax revenue. Twenty-five percent (25%) to the Department of Natural and Cultural Resources to be used as provided in G.S. 121-5(e). History (2009-451, s. 17.8(b); 2011-296, s. 3; 2013-225, s. 7(a); 2015-241, s. 14.30(s).) Editor's Note. - Session Laws 2015-241, s. 1.1, provides: "This act shall be known as 'The Current Operations and Capital Improvements Appropriations Act of 2015.'" Session Laws 2015-241, s. 33.6, is a severability clause. Effect of Amendments. - Session Laws 2011-296, s. 3, as amended by Session Laws 2013-225, s. 7(a), effective October 1, 2011, and applicable to instruments registered on or after that date, rewrote the section catchline, which formerly read: "Fees for General Fund support"; in the introductory paragraph, rewrote the first sentence, which formerly read: "Five dollars ($5.00) of each fee collected by the register of deeds for registering or filing a deed of trust or mortgage pursuant to G.S. 161-10(a)(1a) shall be remitted by the register of deeds to the county finance officer, who shall remit the funds to the State Treasurer to be credited to the General Fund as a nontax revenue," and deleted the last sentence, which read: "The county finance officer shall remit the funds to the State Treasurer on a monthly basis"; and added subdivisions (1) through (3). Session Laws 2015-241, s. 14.30(s), effective July 1, 2015, substituted "Department of Natural and Cultural Resources" for "Department of Cultural Resources" in subdivision (3).
