§ 160D-111. Effect on prior laws.
The enactment of this Chapter does not require the readoption of any local government ordinance enacted pursuant to laws that were in effect before June 19, 2020 and are restated or revised herein. The provisions of this Chapter do not affect any act heretofore done, any liability incurred, any right accrued or vested, or any suit or prosecution begun or cause of action accrued as of June 19, 2020. The enactment of this Chapter does not amend the geographic area within which local government development regulations adopted prior to June 19, 2020, are effective. G.S. 153A-3 and G.S. 160A-3 are applicable to this Chapter. Nothing in this Chapter repeals or amends a charter or local act in effect as of June 19, 2020 unless this Chapter or a subsequent enactment of the General Assembly clearly shows a legislative intent to repeal or supersede that charter or local act. Whenever a reference is made in another section of the General Statutes or any local act, or any local government ordinance, resolution, or order, to a portion of Article 19 of Chapter 160A of the General Statutes or Article 18 of Chapter 153A of the General Statutes that is repealed or superseded by this Chapter, the reference is deemed amended to refer to that portion of this Chapter that most nearly corresponds to the repealed or superseded portion of Article 19 of Chapter 160A or Article 18 of Chapter 153A of the General Statutes. History (2019-111, s. 2.4; 2020-3, s. 4.33(a); 2020-25, ss. 6, 51(a)-(d).) Editor's Note. - Session Laws 2020-3, s. 5, is a severability clause. Session Laws 2020-25, s. 51(b), provides: "Part II of S.L. 2019-111 [which enacted this Chapter] is effective when this act becomes law [June 19, 2020]. Part II of S.L. 2019-111 clarifies and restates the intent of law existing on the effective date of this act [June 19, 2020] and applies to ordinances adopted before, on, and after that date. Valid local government development regulations that are in effect at the time of the effective date of Part II of S.L. 2019-111 remain in effect but local governments shall amend those regulations to conform to the provisions of Part II of S.L. 2019-111 on or before July 1, 2021. Part II of S.L. 2019-111 applies to local government development regulation decisions made on or after the earlier of: "(1) The effective date of the amendments to local development regulations made to conform to the provisions of Part II of S.L. 2019-111 or "(2) July 1, 2021." Session Laws 2020-25, s. 51(c), provides: "The Revisor of Statutes is authorized to substitute the effective date of this act for 'January 1, 2021' throughout Chapter 160D of the General Statutes." Pursuant to this authority, the Revisor of Statutes substituted "June 19, 2020” for "January 1, 2021” in this section. Effect of Amendments. - Session Laws 2020-25, s. 6, effective June 19, 2020, substituted "January 1, 2021" for "January 1, 2019" in subsection (a); and made minor stylistic changes throughout the section.
