§ 147-54. 10. Powers.
At least 75 days before an election in which a proposed amendment to the Constitution, or a revised or new Constitution, is to be voted on, the Commission shall prepare an explanation of the amendment, revision, or new Constitution in simple and commonly used language. The summary prepared by the Commission shall be printed by the Secretary of State, in a quantity determined by the Secretary of State. A copy shall be sent along with a news release to each county board of elections, and a copy shall be available to any registered voter or representative of the print or broadcast media making request to the Secretary of State. The Secretary of State may make copies available in such additional manner as the Secretary may determine. History (1983, c. 844, s. 1; 2016-109, s. 4(b); 2018-131, s. 2.) Editor's Note. - Session Laws 2016-109, s. 10, made the amendment to this section by Session Laws 2016-109, s. 4(b), applicable to elections held on or after July 22, 2016. Effect of Amendments. - Session Laws 2016-109, s. 4(b), effective July 22, 2016, added subsection designations (a) and (b); in subsection (a), substituted "75" for "60" in the first sentence and added the last sentence; and in subsection (b), substituted "the Secretary" for "he" in the last sentence. See editor's note for applicability. Session Laws 2018-131, s. 2, effective August 4, 2018, deleted the last sentence in subsection (a), which formerly read: "The explanation shall include a short caption reflecting the contents, that shall not include a numerical or other reference of order, to be used on the ballot and the printed summary."
