§ 122C-212. Discharges.

Except as provided in subsection (b) of this section, an individual who has been voluntarily admitted to a facility shall be discharged upon the individual's own request. A request for discharge from a 24-hour facility shall be in writing. An individual who has been voluntarily admitted to a 24-hour facility may be held for 72 hours after the individual's written application for discharge is submitted. Effect of Amendments. - Session Laws 2018-33, s. 13, in subsection (a), in the first sentence, substituted "subsection (b)" for "subsections (b) and (c)" and "the individual's own" for "his own"; in subsection (b), substituted "the individual's written" for "his written"; and deleted former subsection (c), which read: "When an individual from a single portal area who has been voluntarily admitted to an area or State 24-hour facility is discharged, the discharge shall follow the procedures as prescribed in the area plan."
