§ 121-9. 1. Lake Mattamuskeet Lodge Preservation.
Notwithstanding G.S. 121-9, the State of North Carolina accepts the transfer of the Mattamuskeet Lodge and surrounding property to the State under the Lake Mattamuskeet Lodge Preservation Act, P.L. 109-358. The property shall be transferred to and managed by the Wildlife Resources Commission. Repealed by Session Laws 2016-94, s. 14.14(b), effective July 1, 2016. History (2007-13, ss. 1, 2; 2015-241, s. 14.30(s); 2016-94, s. 14.14(b).) Editor's Note. - Session Laws 2007-13 provides in its preamble: "Whereas, the Lake Mattamuskeet Lodge Preservation Act, P.L. 109-358, became law October 16, 2006, and provides for transfer to the State of North Carolina of a parcel of real property consisting of approximately 6.25 acres and containing Mattamuskeet Lodge and surrounding property, including the Mattamuskeet National Wildlife Refuge headquarters; and "Whereas, Section 2(b) of that act provides the transfer is conditional on the State of North Carolina agreeing to restore and maintain the lodge in accordance with Article 1 of Chapter 121 of the General Statutes, the North Carolina Archives and History Act; and "Whereas, due to the unique nature of the property, after repairs and renovations are completed the Wildlife Resources Commission will be a more appropriate management agency; Now, therefore,". Session Laws 2016-94, s. 14.14(b), had deleted the subsection (a) designation and subsection (b), altogether. The section has been set out in the form above at the direction of the Revisor of Statutes. Session Laws 2016-94, s. 14.14(a), (c), provides: "(a) The Mattamuskeet Lodge and surrounding property transferred from the federal government by Public Law 109-358, entitled the 'Lake Mattamuskeet Lodge Preservation Act,' is reallocated from the Department of Natural and Cultural Resources to the Wildlife Resources Commission. "(c) The Wildlife Resources Commission shall undertake advanced planning for the completion of renovations of the Lake Mattamuskeet Lodge and explore opportunities for a public-private partnership for the future operation of the Lodge to optimize the sustainability and benefit of the Lodge to the community. In order to conduct these activities, the Commission may use up to two hundred thousand dollars ($200,000) of the funds appropriated to it for the 2016-2017 fiscal year. The Commission shall report to the Joint Legislative Oversight Committee on Agriculture and Natural and Economic Resources no later than January 15, 2017, regarding its implementation of the requirements of this section." Session Laws 2016-94, s. 1.2, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2016.'" Session Laws 2016-94, s. 39.4, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2016-2017 fiscal year, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2016-2017 fiscal year." Session Laws 2016-94, s. 39.7, is a severability clause. Session Laws 2017-57, s. 13A.1, provides: "From funds available to it, the Wildlife Resources Commission shall repair the roof and stabilize the tower at the Mattamuskeet Lodge in Hyde County. The Commission shall complete the repairs required by this section no later than June 30, 2018." Effect of Amendments. - Session Laws 2007-13, s. 2, effective July 1, 2007, substituted "G.S. 143C-4-3" for "G.S. 143-15.3A" in subsection (b). Session Laws 2015-241, s. 14.30(s), effective July 1, 2015, substituted "Department of Natural and Cultural Resources" for "Department of Cultural Resources" in subsection (a). Session Laws 2016-94, s. 14.14(b), effective July 1, 2016, in the second sentence of subsection (a), substituted "The" for "After completion of repairs and renovations by the Department of Natural and Cultural Resources" preceding "property shall be transferred"; and repealed former subsection (b) pertaining to Wildlife Resources Commission review of repair and renovation plans.
