§ 116-280. Definitions.

The following definitions apply to this Article: Academic year. - A period of time in which a student is expected to complete the equivalent of at least two semesters' or three quarters' academic work. Armed Forces. - As defined in G.S. 116-143.3(a)(2). Authority. - The State Education Assistance Authority created by Article 23 of Chapter 116 of the General Statutes. Eligible private postsecondary institution. - A school that is any of the following: A nonprofit postsecondary educational institution with a main permanent campus located in this State that is not owned or operated by the State of North Carolina or by an agency or political subdivision of the State or by any combination thereof that satisfies all of the following: Is either (i) accredited by the Southern Association of Colleges and Schools Commission on Colleges (SACSCOC) or by the New England Association of Schools and Colleges through its Commission of Higher Education or (ii) was accredited by SACSCOC on January 1, 2021, and, beginning January 1, 2021, was a member of the Transnational Association of Christian Colleges and Schools. Awards a postsecondary degree as defined in G.S. 116-15. A postsecondary institution owned or operated by a hospital authority as defined in G.S. 131E-16(14) or school of nursing affiliated with a nonprofit postsecondary educational institution as defined in sub-subdivision a. of this subsection. Main permanent campus. - A campus owned by the eligible private postsecondary institution that provides permanent on-premises housing, food services, and classrooms with full-time faculty members and administration that engages in postsecondary degree activity as defined in G.S. 116-15. Matriculated status. - Being recognized as a student in a defined program of study leading to a degree, diploma, or certificate at an eligible private postsecondary institution. Scholarship. - A scholarship for education awarded under this Article. Title IV. - Title IV of the Higher Education Act of 1965, as amended, 20 U.S.C. § 1070, et seq. Veteran. - A veteran as defined in G.S. 116-143.3A who was discharged or released from service under conditions other than dishonorable. Editor's Note. - Session Laws 2011-145, s. 9.18(i), made this Article effective July 1, 2011, and applicable to the 2012-2013 academic year and each subsequent academic year, except that the rule-making authority for the State Education Assistance Authority under G.S. 116-283(a) became effective immediately on July 1, 2011. Session Laws 2011-145, s. 9.18(d), as amended by Session Laws 2012-142, s. 9.2(b), provides: "The State Education Assistance Authority shall report no later than September 1, 2013, to the Joint Legislative Education Oversight Committee regarding the implementation of this section. The report shall contain, for the 2012-2013 academic year, the amount of scholarship and grant money disbursed, the number of students eligible for the funds, the number of eligible students receiving the funds, and a breakdown of the eligible private postsecondary institutions that received the funds." Session Laws 2011-145, s. 1.1, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2011.'" Session Laws 2011-145, s. 32.2, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2011-2013 fiscal biennium, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2011-2013 fiscal biennium." Session Laws 2011-145, s. 32.5, is a severability clause. Session Laws 2012-142, s. 9.2(d), provides: "Of the funds appropriated by this act to the Board of Governors for the 2012-2013 fiscal year and allocated to the State Education Assistance Authority for the North Carolina Need-Based Scholarships for Students Attending Private Institutions of Higher Education pursuant to Article 34 of Chapter 116 of the General Statutes, the State Education Assistance Authority may use up to two hundred eighty-one thousand five hundred seventeen dollars ($281,517) to make the payments authorized by subsection (c) of this section to students who attended certain private institutions of higher education in the 2011-2012 academic year." Session Laws 2012-142, s. 1.2, provides: "This act shall be known as 'The Current Operations and Capital Improvements Appropriations Act of 2012.'" Session Laws 2012-142, s. 27.4, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2012-2013 fiscal year, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2012-2013 fiscal year." Session Laws 2012-142, s. 27.7, is a severability clause. Session Laws 2018-5, s. 10A.6(c), made subdivision (8) of this section, as added by Session Laws 2018-5, s. 10A.6(a), appplicable beginning with the 2018-2019 academic year. Session Laws 2018-5, s. 1.1, provides: "This act shall be known as the 'Current Operations Appropriations Act of 2018.'" Session Laws 2018-5, s. 39.7, is a severability clause. Session Laws 2018-97, s. 2.17(c), made subdivision (1a) of this section, as added by Session Laws 2018-97, s. 2.17(a), applicable beginning with the 2018-2019 academic year. Session Laws 2021-15, s. 2, made the rewriting of sub-sub-subdivision (3)a.1. of this section by Session Laws 2021-15, s. 1, effective April 27, 2021, and applicable beginning with scholarships awarded for the 2021-2022 academic year. Effect of Amendments. - Session Laws 2018-5, s. 10A.6(a), effective July 1, 2018, added subdivision (8). For applicability, see editor's note.
