§ 115C-499. 1. Definitions.
The following definitions apply to this Article: Academic year. - A period of time in which a student is expected to complete the equivalent of at least two semesters' or three quarters' academic work. Authority. - The State Education Assistance Authority created by Article 23 of Chapter 116 of the General Statutes. Eligible postsecondary institution. - A school that is: A constituent institution of The University of North Carolina as defined in G.S. 116-2(4); or A community college as defined in G.S. 115D-2(2). , d. Repealed by Session Laws 2011-145, s. 9.18(b), effective July 1, 2012. Matriculated status. - Being recognized as a student in a defined program of study leading to a degree, diploma, or certificate at an eligible postsecondary institution. Scholarship. - A scholarship for education awarded under this Article. Title IV. - Title IV of the Higher Education Act of 1965, as amended, 20 U.S.C. § 1070, et seq. History (2005-344, s. 2; 2006-66, s. 9.19; 2006-221, s. 5B; 2006-259, s. 8(h); 2011-145, s. 9.18(b).) Editor's Note. - Session Laws 2005-344, s. 14, provides: "Nothing in this act shall be construed to obligate the General Assembly to appropriate funds to implement this act." Session Laws 2010-31, s. 5.1(f), provides: "Notwithstanding G.S. 18C-164(c) , Article 35A of Chapter 115C of the General Statutes, or any other provision of law, of the funds appropriated in this section for Scholarships for Needy Students, the sum of twenty-six million six hundred sixty-one thousand forty-six dollars ($26,661,046) shall be administered in accordance with the policy adopted by the Board of Governors of The University of North Carolina." Session Laws 2010-31, s. 1.1, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2010'." Session Laws 2010-31, s. 32.3, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2010-2011 fiscal year, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2010-2011 fiscal year." Session Laws 2010-31, s. 32.6, is a severability clause. Session Laws 2012-142, s. 5.3(i), provides: "Notwithstanding G.S. 18C-164(c) , Article 35A of Chapter 115C of the General Statutes, or any other provision of law, the funds appropriated in this section for UNC Need-Based Financial Aid shall be administered in accordance with the policy adopted by the Board of Governors of The University of North Carolina." Session Laws 2012-142, s. 1.2, provides: "This act shall be known as 'The Current Operations and Capital Improvements Appropriations Act of 2012.'" Session Laws 2012-142, s. 27.4, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2012-2013 fiscal year, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2012-2013 fiscal year." Session Laws 2012-142, s. 27.7, is a severability clause. Effect of Amendments. - Session Laws 2006-66, s. 9.19, as added by Session Laws 2006-221, s. 5B, effective July 1, 2006, substituted "nonprofit" for "nonpublic" in sub-subdivision (3)c.; added sub-subdivision (3)d.; and made minor stylistic and punctuation changes. Session Laws 2006-259, s. 8.(h), effective August 24, 2006, substituted "G.S. 116-43.5(a)(1)" for "116-43.5(a)(1)" at the end of subdivision (3)c. Session Laws 2011-145, s. 9.18(b), effective July 1, 2012, deleted subdivision (3)c., which read: "A nonprofit postsecondary institution as defined in G.S. 116-221(1) or G.S. 116-43.5(a)(1) " and made related changes; and deleted subdivision (3)d., which read: "A postsecondary institution owned or operated by a hospital authority as defined in G.S. 131E-16(14) or school of nursing affiliated with a nonprofit postsecondary institution as defined in G.S. 116-22(1) .
