§ 127B-35. Action by Attorney General.
Civil Action. - The Attorney General may commence a civil action against any person that violates any provision of this Article. Remedies. - The court may order any of the following remedies: Injunction. Payment of restitution to a servicemember in the amount of money unlawfully received from, or required to be refunded to, the servicemember. Any other remedy provided under Chapter 75 of the General Statutes. Civil Penalty. - The court may assess a civil penalty not to exceed five thousand dollars ($5,000) per violation. The clear proceeds of civil penalties imposed pursuant to this section shall be remitted to the Civil Penalty and Forfeiture Fund in accordance with G.S. 115C-457.2. History (2019-161, s. 1(a).) Editor's Note. - Session Laws 2019-161, s. 1(e), made this section effective October 1, 2019, and applicable to contracts entered into, renewed, or modified on or after that date.
