§ 127A-50. 1. Military judges.
The Adjutant General shall appoint military judges to preside over courts-martial of the North Carolina National Guard not in federal service. Minimum requirements for appointment as a military judge are: Certification as a military judge by the Judge Advocate General of the United States Army, Air Force, Navy, Marines, or Coast Guard. Designation as a judge advocate by the Judge Advocate General of the United States Army, Navy, Air Force, Marines, or Coast Guard. Membership in the North Carolina National Guard, the National Guard of another state, or the active or reserve components of the Armed Forces of the United States. History (1987, c. 649, s. 1; 2010-193, s. 5; 2011-195, s. 1(a).) Editor's Note. - Session Laws 2010-193, s. 23, provides: "Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions." The Act became effective December 1, 2010. Effect of Amendments. - Session Laws 2010-193, s. 5, effective December 1, 2010, and applicable to offenses committed on or after that date, at the end of the introductory paragraph, substituted "are" for "shall be"; rewrote subdivision (1), which formerly read: "Licensed to practice law in this State or certified as a military judge by the Judge Advocate General of the Army, Air Force, Navy, or Marines"; and, in subdivision (2), added "or Coast Guard" and made a related grammatical change. Session Laws 2011-195, s. 1(a), effective June 23, 2011, in the introductory language, inserted "North Carolina"; in subdivisions (1) and (2), inserted "United States"; and in subdivision (3), substituted "the Armed Forces of the United States" for "any of the military services."
