§ 127A-47. Courts-martial for National Guard.

Courts-martial for military personnel of the North Carolina National Guard not in the service of the United States shall be of three kinds, namely, general courts-martial, special courts-martial, and summary courts-martial. They shall be constituted, have cognizance of the same subjects, and possess like powers as similar courts provided for by the Uniform Code of Military Justice and Manual for Courts-Martial, United States. The proceedings of courts-martial of the North Carolina National Guard shall follow the forms and modes of procedure prescribed for such similar courts. History (1917, c. 200, s. 55; C.S., s. 6825; 1963, c. 1018, s. 1; 1975, c. 604, s. 2; 2009-281, s. 1; 2010-193, s. 1; 2011-195, s. 1(a).) Editor's Note. - Session Laws 2010-193, s. 23, provides: "Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions." This Act became effective December 1, 2010. Effect of Amendments. - Session Laws 2009-281, s. 1, effective July 10, 2009, substituted "National Guard" for "national guard" twice in this section. Session Laws 2010-193, s. 1, effective December 1, 2010, and applicable to offenses committed on or after that date, throughout the section, substituted "National Guard" for "national guard"; and in the second sentence, deleted "except as to punishments" following "possess like powers" and substituted "provided for by the Uniform Code of Military Justice and Manual for Courts-Martial, United States. The proceedings" for "provided for by the law and regulations governing the armed forces of the United States and the proceedings." Session Laws 2011-195, s. 1(a), effective June 23, 2011, substituted "military personnel of the North Carolina National Guard" for "organizations of the National Guard" in the first sentence, and inserted "North Carolina" in the last sentence.
