§ 116-209. 53. Benefit.
The benefit provided under this Part shall consist of a monetary educational assistance grant not to exceed the highest amount charged by a State educational institution per academic year or a lesser amount, as prescribed by the Authority, to remain within the funds appropriated, to qualifying members of the North Carolina National Guard. Benefits provided under G.S. 116-209.55(g) shall be payable for a period of one year at a time, renewable at the option of the Authority. All other benefits provided under this Part shall be payable for a period of one academic year at a time, renewable at the option of the Authority. Editor's Note. - This section is former G.S. 127A-193, as recodified by Session Laws 2010-31, s. 17.3(b). The historical citation from the former section has been added to this section as recodified. At the direction of the Revisor of Statutes, "this Part" was twice substituted for "this Article" to conform to the recodification by Session Laws 2010-31, s. 17.3(b). Session Laws 2010-31, s. 1.1, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2010'." Session Laws 2010-31, s. 32.6, is a severability clause. Effect of Amendments. - Session Laws 2005-444, s. 1, effective July 1, 2005, rewrote the section. Session Laws 2008-94, s. 3, effective July 1, 2008, rewrote the second sentence, which read: "Benefits shall be payable for a period of one academic year at a time, renewable at the option of the Secretary," added the third sentence, and made a grammatical change. Session Laws 2010-31, s. 17.3(c), effective July 1, 2010, substituted "Authority" for "Secretary" three times and substituted "G.S. 116-209.55(g)" for "G.S. 127A-195(g)."
