§ 75A-38. Commission's records; fees.

The Commission shall maintain a record of any title it issues. The Commission shall charge a fee of thirty dollars ($30.00) to issue a new or transfer certificate of title. The Commission shall transfer on a quarterly basis at least ten dollars ($10.00) of each new or transfer certificate of title to the Shallow Draft Navigation Channel Dredging and Aquatic Weed Fund established by G.S. 143-215.73F. The Commission shall charge a fee of ten dollars ($10.00) for each duplicate title it issues and for the recording of a supplemental lien. Editor's Note. - Session Laws 2013-360, s. 14.22(i), provides: "Nothing in this section shall affect the validity, term, or cost of any certificate of number or certificate of title issued prior to October 1, 2013." Session Laws 2013-360, s. 14.22( l ), made the amendment to this section by Session Laws 2013-360, s. 14.22(f), applicable to new or transfer certificates of title issued on or after October 1, 2013. Session Laws 2013-360, s. 1.1, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2013.'" Session Laws 2013-360, s. 38.2, provides: "Except for statutory changes or other provisions that clearly indicate an intention to have effects beyond the 2013-2015 fiscal biennium, the textual provisions of this act apply only to funds appropriated for, and activities occurring during, the 2013-2015 fiscal biennium." Session Laws 2013-360, s. 38.5 is a severability clause. Session Laws 2016-94, s. 1.2, provides: "This act shall be known as the 'Current Operations and Capital Improvements Appropriations Act of 2016.'" Session Laws 2016-94, s. 39.7, is a severability clause. Effect of Amendments. - Session Laws 2006-185, s. 2, effective January 1, 2007, and applicable to offenses committed on or after January 1, 2007, in subsection (b), substituted "to issue a new or transfer certificate of title. The Commission shall charge a fee of" for "for issue of each certificate of title, and" and substituted "duplicate title it issues and for the" for "transfer of title, duplicate title, or" near the end. Session Laws 2013-360, s. 14.22(f), effective October 1, 2013, in subsection (b), substituted "thirty dollars ($30.00)" for "twenty dollars ($20.00)," and added the second sentence. For applicability, see editor's note. Session Laws 2014-100, s. 14.19(c), effective July 1, 2014, substituted "Shallow Draft Navigation Channel Dredging and Lake Maintenance Fund" for "Shallow Draft Navigation Channel and Lake Dredging Fund" in the second sentence in subsection (b). Session Laws 2016-94, s. 14.12(c), effective July 1, 2016, substituted "Aquatic Weed Fund" for "Lake Maintenance Fund" in the second sentence of subsection (b).
