§ 58:10-23.

a. The Department of Environmental Protection shall compile a list of facilities which,

based on all information made available to or collected by the department pursuant

to any State or federal law, may have sufficient storage capacity to be classified

as a major facility. b. The department shall transmit this list to the Director of the Division of Taxation

in the Department of the Treasury on January 1 of the year next following the enactment

of this act and annually thereafter, provided that the department may update the list

more frequently as it deems appropriate. c. The director shall utilize the list compiled by the department to notify the owners

or operators of the facilities thereon that they may be liable for the tax levied

pursuant to section 9 of P.L. 1976, c. 141 ( C. 58:10-23.11h ). d. The owner or operator of a facility so notified by the director shall pay the tax

or provide an explanation as to why the facility should not be classified as a major

facility.
