§ 56:8-39.
As used in this act: a. “ Director ” means the Director of the Division of Consumer Affairs in the Department of Law
and Public Safety. b. “ Health club ” means an establishment which devotes or will devote 40% or more of its square footage
to providing services or facilities for the preservation, maintenance, encouragement
or development of physical fitness or physical well-being. The term includes an establishment designated as “reducing salon,” “health spa,”
“spa,” “exercise gym,” “health studio,” “health club,” or by other terms of similar
import. c. “ Health club services ” means those services offered by a health club for the preservation, maintenance,
encouragement or development of physical fitness or physical well-being. d. “ Health club services contract ” means an agreement under which the buyer of health club services purchases or becomes
obligated to purchase health club services. e. “ Operating day ” means any calendar day on which patrons may inspect and use the health club's facilities
and services during a period of at least eight hours, except holidays and Sundays.
