§ 4:1c-30.

a. Withdrawal of land from the municipally approved program or other farmland preservation

program prior to its termination date may occur in the case of death or incapacitating

illness of the owner or other serious hardship or bankruptcy, following a public hearing

conducted pursuant to the “Open Public Meetings Act,” P.L. 1975, c. 231 ( C. 10:4-6 et seq. ) and approval by the board and in the case of a municipally approved program, the

municipal governing body, at a regular or special meeting thereof. The approval shall be documented by the filing with the county clerk and county

planning board, by the board and municipal governing body, of a resolution or ordinance,

as appropriate, therefor. The local tax assessor shall also be notified by the board of this withdrawal. b. Following approval to withdraw from the municipally approved program, the affected

landowner shall pay to the municipality, with interest at the rate imposed by the

municipality for nonpayment of taxes pursuant to R.S. 54:4-67 , any taxes not paid as a result of qualifying for the property tax exemption for

new farm structures or improvements in the municipally approved program, as authorized

and provided in the Constitution, and shall repay, on a pro rata basis as determined

by the local soil conservation district, to the board or the committee, or both, as

the case may be, any remaining funds from grants for soil and water conservation projects

provided pursuant to the provisions of this act, except in the case of bankruptcy,

death or incapacitating illness of the owner, where no such payback of taxes or grants

shall be required.
