§ 44:8-159.
a. The Commissioner of Human Services shall contract with manufacturers of pharmaceutical
products to provide rebates for pharmaceutical products covered under the Work First
New Jersey General Public Assistance program (WFNJ-GA), established pursuant to P.L.1947,
c. 156 ( C.44:8-107 et seq. ) on the same basis as is required under the “Pharmaceutical Assistance to the Aged
and Disabled” program established pursuant to P.L.1975, c. 194 ( C.30:4D-20 et seq. ) and “Senior Gold Prescription Discount Program” established pursuant to P.L.2001, c. 96 ( C.30:4D-43 et seq. ) and in section 1927(a) through (c) of the federal Social Security Act, 42 U.S.C. s.1396r-8(a) - (c) . b. The contracts entered into pursuant to this section shall take effect on the date
of enactment of P.L.2005, c. 156 ( C.30:4J-8 et al.). (1) A manufacturer who is participating in the WFNJ-GA program on the date of enactment
of P.L.2005, c. 156 shall enter into a contract, as a condition of continued participation in the program. (2) A manufacturer who was not participating in the WFNJ-GA program on the date of
enactment of P.L.2005, c. 156 may enter into a contract with the commissioner and become a participating manufacturer. (3) A manufacturer who participates in the WFNJ-GA program pursuant to this section
shall provide to the commissioner such information as the commissioner may request
to carry out the purposes of this section.
