§ 3a:24-27.
If a mortgagee or holder of a mortgage upon, or judgment creditor or holder of a judgment
against, the real estate of a decedent has filed a claim upon the debt secured by
the mortgage or on the judgment, with the executor or administrator of the decedent,
and it shall appear to the court to be necessary to sell the real estate covered by
the mortgage or encumbered by the lien of such judgment for the payment of the debts
of the decedent, the court may direct the same sold free and clear of the mortgage
or lien; but the court shall at the same time direct the proceeds of such sale to
be applied first in payment of the mortgage debt or judgment debt, as the case may
be. Any balance thereafter remaining shall be assets in the hands of the executor or
administrator.
